1.1 Website ownership

The madeincire.cat website is owned by the CENTRE FOR INITIATIVES FOR REINTEGRATION (CIRE), with postal address Calle Foc, 57, 08038 Barcelona and CIF: Q5856204B

1.2 Purpose and scope of application

The conditions of use described below define the rights and obligations within the framework of its website and in commercial transactions between CIRE and its users.

The simple navigation of this website, as well as the use of the e-commerce services offered, implies at all times the acceptance of each of the established conditions.

1.3 Information provided on the website

We at madeincire.cat do our best to ensure that the goods and services offered are accurately and precisely described. Even so, the visual (images) or written information and data included in each product/service have an informative and guiding function, which is why CIRE is not responsible in any case for the appearance of errors in this information.

We reserve the right to modify the Terms of Use. Any new version of the latter will be indicated in advance. In the event that any of the terms of the Terms of Use are declared illegal or unenforceable by a court decision, the remaining provisions shall remain in force.

1.4 Referral to third-party websites

CIRE has no control over the content of these third-party websites, and in any case, it is not responsible for the veracity of this information and the use made of it.  CIRE does not exercise any control over these spaces and contents. However, it shall not be liable for any damage caused by the use of these links or by the information contained therein, including when expressly advised of the possibility of damage.

Links to third-party spaces do not imply a subscription to the content by CIRE. These links may only be provided to inform the User about the existence of other sources of information or commercial interest. 1.5 Overview

The items offered on this website are products from the Made in CIRE collections and meet the same quality and guarantee requirements as the products offered for sale in commercial establishments.

Each product is accompanied by the following information:

  • Item Name
  • Item Image(s)
  • Item Description
  • Price (in the corresponding currency)

1.6 Conditions and process of placing orders

To place an order, you will have to register as a user by filling in the electronic form that appears in the store at any time and following the instructions indicated. After registering, in order to buy, you must add the product you wish to purchase to the cart, according to the instructions on the screen, fill in the order form and validate it. The validation of the order by the customer expressly implies knowledge and acceptance of these general terms and conditions of contract as part of the conclusion of the contract.

The order form will request personal data, which will be incorporated into our file called Commercial Management in order to be able to process the order and in order to facilitate the making of new purchases in our store. At any time, users will be able to access their personal data.

Once the purchase order has been completed, before the order is shipped, a summary will be presented that will identify the item purchased, its total price (transport and taxes included) and the shipping data. The order must be confirmed by clicking on the “Accept Purchase” button.

The payment method enabled is a credit card, a secure debit card (VISA, MASTERCARD, JCB), or through PayPal.

1.7 Availability

The interested party can choose between the goods/services available on the website, within the selected period. The products offered are distributed worldwide.

1.8 Exchanges and returns

If you are not satisfied with the purchase upon receipt, you may exchange or return it within fourteen (14) days from the date of receipt, provided that the item has not been used or damaged. Consequently, CIRE will not be able to accept exchanges or returns of damaged or used items, or without their original packaging. Once we receive the product under the conditions mentioned above, we will refund the value of the order.

It is very important that the exchange or return products are returned perfectly packaged because in case the products are damaged due to improper packaging, the return will not be accepted.

The product may also be returned to the transport company in the event that the product is defective at origin, or if the product, due to an error by CIRE, does not correspond to the order. In this case, the collection and redelivery of the product will be processed.

The refund procedure will be as follows:

  • Return the package to PUKKA’S WEBS DESIGN, S.L. (Pukkas), located at Calle Balmes, 245-247, 5º 4ª, (08006) Barcelona,
  • Once PUKKA’S receives the goods in its warehouses and verifies that the conditions described above are met, PUKKA’S will accept the return of the product and will refund the amount – deducting the shipping cost incurred when sending you the product – in accordance with the payment method made and, where appropriate, the new product will be sent. If the payment was made via credit card, the amount will be credited to the same credit card. If the payment was not made by credit card, an account number will be requested where the amount can be paid.
  • The user will receive a refund of the amount within a maximum period of 30 days from the receipt of the returned product in our warehouse.

It is important to bear in mind that, if the payment is made by credit card, it is likely that your bank will not show the amount of the refund in your balance until the following month.

The cost of shipping for the return of a product is borne by the user, except in cases of defective product at origin or error in the product ordered. In this case, the costs will be borne by PUKKA’S.

1.9 Payment and prices of services

Prices will be as described on the website. Prices include indirect taxes (value added tax).

Likewise, the transport of the purchased items will be done by a courier company and the items will be delivered within the deadlines detailed below, depending on the destination of the goods:

Transport fees include the corresponding VAT.

To avoid incidents in the delivery (wrong addresses, impossibility of finding someone at home, etc.), it is essential to fill in the corresponding form correctly, and it is also mandatory to fill in the box relating to the contact telephone numbers.

These periods can be longer during a few weeks of the year, such as the Christmas period. In any case, CIRE is obliged to announce this casuistry to the user, by means of a clear and unequivocal message, before the user processes the payment of the order.

CIRE’s liability is limited in cases of force majeure (strikes, adverse weather phenomena that prevent normal transit by land, sea or air, etc.). In these cases, orders will be delivered as soon as possible, and the deadlines stated above will not apply.

1.10 Responsibilities

The User acknowledges that he/she his/her website is operated madeincire.cat at his/her own risk and/or responsibility and acknowledges that the Service and any elements therein, including but not limited to the content, services, advertisements (the “Elements”) are provided explicitly and that madeincire.cat does not expressly or implicitly warrant the elements including,   among others, non-compliance, title or suitability for a particular purpose or use. madeincire.cat does not warrant that your website will madeincire.cat be compatible with your hardware or software, nor that the service is error-free, virus-free or “marlware” and is not responsible for any damage caused by these destructive elements.

The User acknowledges and accepts that any contractual or non-contractual relationship that, where appropriate, may be formalized with the advertisers or third parties contacted through madeincire.cat, is understood to be made solely and exclusively between the User and the advertiser and/or third party. Therefore, the User accepts that madeincire.cat has no liability whatsoever for damages of any nature caused by reason of its negotiations, conversations and/or contractual or non-contractual relations with advertisers or third parties contacted madeincire.cat cannot be held responsible for the breach of the contract signed in the event of inability to make effective the intermediation in the purchase and sale of access to your application. account by means unrelated to CIRE or reasons of force majeure, interruption of activity or total or partial failure, in particular, of the telematic services in the area where the User is located.

CIRE also limits its liability in the following cases:

  • Technical bankruptcies that, due to fortuitous or other causes, may prevent normal operation through the Internet. Lack of availability of the Website for maintenance or other reasons, which may prevent the service.
  • In general, CIRE will not be responsible for any failure or delay in the fulfillment of any of the obligations assumed, when it is due to events that are beyond reasonable control, that is, that may be due to force majeure and this may include, but is not limited to:
  • Strikes, lockouts or other industrial action
  • Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
  • Impossibility of using trains, ships, planes, motor transport and other means of transport, public or private.
  • Impossibility of using public or private telecommunications systems.
  • Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended during the period in which the force majeure event continues, and CIRE will have an extension in the term to comply with them for a period of time equal to the duration of the force majeure event.  CIRE will use all reasonable means to find a solution that allows us to comply with our obligations despite the force majeure cause. The portal madeincire.cat excludes any liability for damages of any kind that may be due to the transmission, dissemination, storage, availability, reception, obtaining or access to the services, and in particular, although not exclusively, for damages that may be due to:

  • Failure to comply with the law, morality and generally accepted good customs or public order as a result of obtaining, using or accessing the services;
  • The infringement of intellectual and industrial property rights, industrial secrets, contractual commitments of any kind, the rights to honour, personal and family privacy and the image of persons, property rights and any other rights belonging to a third party as a result of the improper use of the services;
  • Carrying out acts of unfair competition and illegal advertising as a result of the use of the services;
  • The inadequacy for any kind of purpose of and the disappointment of the expectations generated by the services;
  • Default, delay in performance, defective performance or termination for any reason of the obligations contracted by third parties and contracts made with third parties through or on the occasion of access to the services.
  • The madeincire.cat portal is not responsible for the communications that occur between users and merchants, nor for the agreements reached by them as a result of the offers that appear on the website.

1.11 Resignation

No waiver by CIRE of a specific right or legal action or the failure to require strict compliance by the User with any of its obligations, will imply a waiver of other rights or actions derived from a contract or the Conditions, nor will it exonerate the User from compliance with its obligations.

No waiver by CIRE of any of these Conditions or of the rights or actions arising from a contract shall have effect, unless it is expressly stated that it is a waiver and is formalized and communicated to the User in writing.

No waiver by CIRE of a specific right or legal action, or the failure to require a User to comply with any of its obligations, will in any case imply a waiver of other rights or actions derived from a contract or the Conditions, nor will it exonerate the User from compliance with its own obligations.

1.12 Nullity, applicable legislation and jurisdiction

If any of these Terms and Conditions are declared null and void by a final decision issued by the competent authority, the rest of the clauses will remain in force and will not be affected by this declaration of nullity.

Access, browsing and/or use of this website and any controversy, problem or disagreement that may arise or is related to the access, navigation and/or use of the website, or to the interpretation and execution of these Conditions, between CIRE and the User, will be subject to Spanish legislation and the jurisdiction of the Spanish courts and tribunals.

In the event of a dispute, the user may first contact dpdcire@cirecat.org to reach an amicable resolution. In the event of not reaching an agreement, CIRE and the users, expressly waiving any other jurisdiction that may correspond, submit to the courts and tribunals of CIRE’s domicile  for any dispute that may arise from access to or use of the website. In the event that the user is domiciled outside Spain, CIRE and the user submit, expressly waiving any other jurisdiction, to the courts and tribunals of Barcelona.

These Conditions are established will be executed and interpreted in accordance with Spanish regulations and any dispute will be submitted to the Courts and Tribunals of the city of Barcelona.
